The Constitutional Court has dismissed Swifambo Rail Leasing’s application, and upheld that the 2017 High Court ruling that Prasa had awarded the Afro 4000 contract through a corrupt tender process, and that it should, therefore, be set aside.

Has the Constitutional Court set a precedent? Can Transnet now cancel the 22E/45D contracts on similar grounds?
